1. About Us
Penwortham Gardeners is a trading name of Heimdell Tech AI ("we", "us", "our"). By using our website or booking our services, you agree to these terms and conditions.
2. Services
We provide gardening and grounds maintenance services including but not limited to:
- Lawn mowing and treatment
- Hedge trimming and cutting
- Garden tidying and clearance
- Turf laying
- Fencing
- Patio and jet washing
- Seasonal maintenance packages
All services are subject to availability and a suitable assessment of the work required.
3. Quotes & Pricing
- Quotes provided via our website, chatbot (Alan), or by phone are estimates only and may vary once we assess the work in person.
- AI-generated quotes are approximate and intended to give you a ballpark figure. Final pricing will be confirmed before work begins.
- Prices include labour. Materials (e.g. turf, fencing panels) may be charged separately and will be agreed in advance.
- We reserve the right to adjust pricing if the scope of work changes significantly from the original quote.
4. Bookings & Scheduling
- Bookings can be made via our enquiry form, chatbot, phone, or email.
- We will confirm your booking and provide a scheduled date. Dates may be subject to change due to weather or other factors beyond our control.
- For regular maintenance packages (e.g. fortnightly visits), an ongoing schedule will be agreed upon.
5. Cancellations
- By you: You may cancel or reschedule any booking with at least 24 hours' notice at no charge. Cancellations with less than 24 hours' notice may incur a call-out fee.
- By us: We may cancel or reschedule due to severe weather, illness, or unforeseen circumstances. We will notify you as soon as possible and rearrange at no extra cost.
- Regular packages: Either party may end a regular maintenance agreement with 7 days' written notice.
6. Payment
- Payment is due upon completion of work unless otherwise agreed in writing.
- We accept bank transfer, cash, and other payment methods as communicated at the time of booking.
- For larger jobs, we may request a deposit of up to 50% before work commences.
- Late payments may incur reasonable interest charges in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
7. Access & Preparation
- You do not need to be home for us to carry out scheduled work, provided we have safe access to the garden.
- Please ensure pets are secured and any items you wish to protect are moved before our visit.
- If we cannot access the property on the scheduled date, this may be treated as a late cancellation.
8. Liability & Insurance
- We hold public liability insurance to cover accidental damage or injury during the course of our work.
- We will take reasonable care with your property. If accidental damage occurs, please notify us within 48 hours so we can assess and resolve the issue.
- We are not liable for damage to underground pipes, cables, or irrigation systems that are not visible or disclosed to us before work begins.
- Our liability is limited to the cost of the service provided or the cost of remedying the damage, whichever is lower.
9. Satisfaction Guarantee
We take pride in our work. If you're not happy with the standard of service, please contact us within 48 hours and we will return to rectify the issue at no extra charge.
10. AI-Powered Tools
- Our website includes AI-powered features (chatbot, quote tool) for your convenience.
- Information provided by AI tools is for guidance only and does not constitute a binding quote or professional advice.
- AI responses may occasionally be inaccurate. Final details will always be confirmed by a member of our team.
11. Website Use
- The content on our website is for general information and is subject to change without notice.
- You may not use our website for any unlawful purpose or in a way that could damage, disable, or impair the site.
- All content, branding, and design are the property of Heimdell Tech AI and may not be reproduced without permission.
12. Privacy
Your personal data is handled in accordance with our Privacy Policy and UK GDPR. By using our services, you consent to the data practices described therein.
13. Disputes
We aim to resolve any issues informally first. If a dispute cannot be resolved, it will be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.
